Privacy Policy

This Privacy Policy describes the personal information Thumzup Media Corporation (“Thumzup”, “we”, “our”, or “us”) collects from you when you use our mobile application (the “Mobile Application”), how we use it, with whom we share it, and the choices you have in connection with this.

“Advertiser”, as used in this Privacy Policy, is a Thumzup client that has created one or more marketing campaigns through Thumzup’s services.

 

“Creator”, as used in this Privacy Policy, is an individual user who has signed up to participate in one or more Advertisers’ marketing campaigns.

 

APPLICABILITY

 

This Privacy Policy applies to the Mobile Application and our interactions with you through the Mobile Application. For more information about our information practices with respect to our Website, please see our Website Privacy Policy.

INFORMATION WE COLLECT AND USE

 

As you use our Mobile Application, Thumzup will collect personal information from you directly and automatically through cookies as outlined below.

 

A. Information We Collect From Users

 

When you use our Mobile Application, we will collect your personal information when you:

  • Create a Creator Account: When you set up a Creator Account to create advertisements for Advertisers’ campaigns through your social media accounts, we will collect from you your identifiers (name, email address, telephone number, PayPal account information or Venmo handle, social media names or handles). We will use this information to (1) set up your account; (2) verify you to your Thumzup account, social media account, and payment account (Venmo or PayPal); (3) facilitate your communication with the Advertiser; (4) communicate with you about your social media posts; (5) and pay you for your social media posts. Please note that the use of text messages to communicate with you about your social media posts is an essential function of the services. You can opt out of receiving text messages by replying “STOP” or “UNSUBSCRIBE”. However, we will not be able to process your social media posts for payment if you opt out of text message communications.

  • Login to Social Media through the Mobile App: When you log in to your social media account through the Mobile App, we will collect your social media handle and encrypted password. Your social media login credentials and token will by securely stored by encryption technology. Once you login, we will receive a token from the social media platform to link you to your social media account and permit us access to your social media account for 60 days to determine your number of followers. We will also use the token to post upon your request.

 

B.   Information We Collect From Third Parties

 

  • Cash Out: To receive payment for a successful Thumzup post, we will collect your Venmo or PayPal username to facilitate payment. We do not collect or receive access to your financial account information. For more information on Venmo or PayPal payments, please see the respective payment processor’s privacy policy and user agreement.

  • Use the Mobile Application: With your permission, we will collect your precise location using GPS, Bluetooth, cell towers, and Wi-Fi access points. We use this personal information to show your available advertisement opportunities in your area. You can adjust your location access preferences anytime in your mobile device settings. We do not share your precise location with any third party. As you use the Mobile Application, we may collect your image if you submit a Thumzup post that contains an image of yourself. This image is used to facilitate the advertisement campaign you signed up to participate in.

 

Thumzup may also use your personal information collected for the above purposes to send you email marketing communications we feel may be of interest of you. You may opt-out of receiving marketing emails from us by clicking the “unsubscribe” link provided with each email. Please note that we will continue to send you emails necessary to the Mobile Application, your account, or any assistance you request. Thumzup may also use your personal information for other limited circumstances as described in INFORMATION SHARING.

 

C.   Information We Collect Automatically through the Mobile Application

 

In addition to the personal information identified above, when you use the Mobile Application, we and our third-party provider collects your internet and other electronic network activity via SDKs to make the mobile application work as you expect it to and to provide enhanced functionality as described below.  Some of the SDKs we use will store and retrieve information on your device, like a cookie or other similar tracker would. 

 

  • Essential SDKs:  We use essential SDKs which are necessary for the mobile application to function. If you do not provide this information, we would not be able to provide the Mobile Application.

  • Performance SDKs:  When you use the Mobile Application, we automatically collect, through our third party SDK provider, your internet and other electronic network activity regarding your device and use of the Mobile Application.   Thumzup uses the information to test the performance of and improve the Mobile Application for all users.  This information is shared with our third party SDK provider on an aggregated basis.

 

INFORMATION SHARING

 

Thumzup will share your personal information in the following instances:

 

  • Within Thumzup: Where necessary, we will share your personal information within Thumzup in order to efficiently carry out our business and to the extent permitted by law.

 

  • With advertisers: If you post an advertisement on behalf of an advertiser, we will share your Instagram handle and your telephone number with the advertiser to facilitate the posting and advertisement review process.

 

  • With service providers: We will share your personal information with service providers that assist us in providing the Mobile Application, such as our IT support, payment processor, and email vendor.

 

  • In the event of a corporate reorganization: In the event that we enter into, or intend to enter into, a transaction that alters the structure of our organization, such as a reorganization, merger, acquisition, bankruptcy or liquidation or other disposition of assets, we would share your personal information with third parties in connection with the transaction.

 

  • For legal purposes: We will share your personal information where we are legally required to do so, such as in response to court orders, law enforcement or legal process, including for national security purposes; to establish, protect, or exercise our legal rights, as required to enforce our terms of use or other contracts; to defend against legal claims or demands; to detect, investigate, prevent, or take action against illegal activities, fraud, or situations involving potential threats to the rights, property, or personal safety of any person; or to comply with the requirements of any applicable law.

 

  • We do not currently sell any of your personal information under, nor do we plan to do so in the future.

 

CORRECT OR VIEW YOUR PERSONAL INFORMATION

 

You can access your Thumzup account to correct or view certain personal information of yours in our possession and which is associated with your account.

 

UNINSTALL THE MOBILE APPLICATION

 

You can uninstall the Mobile Application at any time - this will stop any further collection of your personal information by the Mobile Application.

 

PUSH NOTIFICATIONS

 

If you have enabled push notifications on the Thumzup Mobile Application, you may disable these at any time by updating your mobile device settings.

 

RIGHTS OF NEVADA RESIDENTS

 

If you are a consumer in the State of Nevada, you may request to opt-out of the current or future sale of your personal information. We do not currently sell any of your personal information under Nevada law, nor do we plan to do so in the future. However, you can submit a request to opt-out of future sales by contacting us at info@thumzupmedia.com. Please include “Opt-Out Request Under Nevada Law” in the subject line of your message. If at any time we decide to sell your personal information, we will update this disclosure accordingly.

 

DO NOT TRACK

 

We do not support Do Not Track.  

 

INFORMATION SECURITY

 

We implement and maintain reasonable safeguards to protect the personal information we collect and maintain, including encryption and access controls. However, no security measure or modality of data transmission over the Internet is 100% secure and we are unable to guarantee the absolute security of the information we have collected from you.

 

AGE RESTRICTION

 

The Mobile Application is not intended for individuals under the age of eighteen (18).  

 

CHANGES TO THIS PRIVACY POLICY

 

We may change this Privacy Policy in our sole discretion. If we make changes, we will post the changes to this page, and will indicate the date the changes go into effect. We encourage you to review our Privacy Policy to stay informed. If we make changes that materially affect your privacy rights, we will notify you with a prominent post on our Mobile Application and/or via email and obtain your consent if required.
